For heaven's sake. What has Moreno gained? A couple of months ago, he was (maybe) a weed company consultant. He's a fast enough talker, he could probably make a living at it.
What does he have now? His company is basically the same. All those shares? They have no value. He hasn't sold anything. THAT would be insider trading.
The people who made money made money on the spike, and those who made money on the short. Insiders shouldn't have shared that info - again, very illegal insider trading - but I sure suspect it happened. That's why Martha Stewart did real jail time.
If you're saying he's going to jail for that, then yes. Dawson, too. But not for the silly share structure deal that has us all upset. That was just a lopsided business deal by Coleridge.
Which makes me wonder... why does Coleridge basically give away VKML? Either a) he's a terrible businessman who got hosed by the street tough, or 2) he wanted to make sure that part of the deal got leaked (spike up) and then the other part of the deal, when officially announced, precipitated a shorters dream crash.
Take your pick, if you have time to think about it while tying the noose.
