Hayter shall simultaneously transmit photocopies of evidence of payment and case identifying information to the Commission’s counsel in this action. By making this payment, Hayter relinquishes all legal and equitable right, title, and interest in such funds and no part of the funds shall be returned to Hayter. The Commission shall hold the funds (collectively, the “Fund”) and may propose a plan to distribute the Fund subject to the Court’s approval. The Court shall retain jurisdiction over the administration of any distribution of the Fund. If the Commission staff determines that the Fund will not be distributed, the Commission shall send the funds paid pursuant to this Judgment to the United States Treasury. The Commission may enforce the Court’s judgment for disgorgement and prejudgment interest, by moving for civil contempt (or through other collection procedures authorized by law) at any time after fourteen days following entry of the Judgment. Hayter shall pay post-judgment interest on any delinquent amounts pursuant to 28 U.S.C. § 1961.

* If the Litigation results were so CRYSTAL CLEAR? Than how come the litigation results give no mention of the (BIHC) prior to the year 2009? It is CRYSTAL CLEAR to me though that BIHC was changed from ticker symbol PRSU.pk in which numerous public posts were issued, and not one of which was regarded in your BIHC stock opinion. Crystal Clear would be explaining to investors of BIHC stock what happened to PRSU.PK stock back in 2007 before BIHC stock had the Transfer Agent change the Ticker symbol in INVESTORS accounts in my opinion. I am not asking for BIHC STOCK to turn the symbol back to PRSU.PK (PRIME RESTAURANT INC), i am asking you why you regard the litigation as being Crystal clear, when obviously half the company is missing in your LITIGATION report in my opinion of speculations........ I bought PRSU.PK stock back in 2007 where did it go, your litigation report only deals with BIHC stock, and the dates that are mentioned wherein....What about Prior Dates RENEE? For exmaple, everybody talks about CRIS GALO and ED H. What ever happened to INGALA and KUSHNER in regards to the public posts made with PRSU.PK stock? What about those public posts to shareholders??? No mention of their names or the company???

ANd Renee, the fact that this company traded one time after shareholders were locked out is deplorable in my opinion of speculations, but you have 14 separate acts which you regard as no big deal because the volume was small????? As an investor it looks like MM's were acting on something maybe they should not have maybe? 14 times they Traded while Investors were locked out, volume was small you say so it was not worthwhile??? Was over ONE MILLION SHARES traded Renee while investors are locked out? WHo are U to say what is High or Small Volume, when NO volume is supposed to be the NORM? Just my own opinions of speculations.....

According to the PACER, it seems the SEC was denied a motion to prevent witnesses from appearing on the part of the defense. SEC was also denied summary judgment as to all counts. Gotta be really embarrassing for the SEC's attorney to get slapped around as the BIH defendants don't appear to have legal counsel.

If you can get them declared worthless do it in a year when you make some profits so you can avoid the capital gains taxes.

Does no good to take the loss in a year when you have no gains. Then you have to save it and use only $3000. each year in future years.

Of course this all depends on how much loss you are talking about.
