Copper Mesa Mining Expected to Lose Junin Project in Ecuador

Ecuador's Ministry of Mines and Petroleum officially terminated Copper Mesa Mining Corporation's (formerly Ascendant Copper) Golden 1 mining concession in Intag, Ecuador on Nov. 12. The Golden 1 concession formed a key part of the company's JUNIN mining project, and constituted the company's most valuable asset. The government action means that the concession will revert back to the government

It is only a matter of time when the other two concessions making up the JUNIN project will be extinguished, in light that they also did not comply with the process of previous consultation with the community and failed to produce a valid environmental impact assessment- which were the basis used by the government for the extinction.

The decision was a direct result of the April 15th Mining Mandate issued by the National Assembly, which extinguished most of the country's mining concessions. The Mandate excludes compensation of any kind for the mining companies.

According to government spokespersons, over 4,000 mining concessions were affected by the Mandate. Projects in the exploitation phase were generally left alone, but nearly all of the ones in exploration phase were affected.

According to the new mining legislation being debated in the provisional National Assembly (the "mini-congress" as it is known here), no mining concessions can be awarded until the government determines the areas designated for mining activities in its National Development Plan, something that could last months or even years.

Copper Mesa and its predecessors (Ascendant Copper Corporation and Ascendant Exploration), have been in the Intag area since 2004, and have been accused of serious human rights abuses, including numerous and documented use of paramilitaries against the local population who are opposed to mining. Its unwelcome presence in the area provoked numerous violent confrontations, which led the government to issue several stop-work orders in late 2006 and early 2007.

The communities of Intag, with the full support of all its local governments and organizations, have been resisting mining development since the 1990's, when the Mitsubishi subsidiary, Bishimetals, discovered copper and molybdenum amidst the Toisan Range's primary forests and pristine rivers and streams. In 1997 due to overwhelming local opposition, Bishimetals was forced to abandon the project.

Copper Mesa Mining Corporation is a Canadian company based in British Columbia who planned through one of its subsidiaries to build an open pit copper mine in the Intag cloud forest just south-west of The Cotacachi Cayapas Ecological Reserve, an area of the Andes Mountains of Ecuador. The company is listed on the Toronto Stock Exchange (TSX), but it does not have significant assets or operations in the province of Ontario aside from two of its non-management directors residing in the province.
The Plaintiffs in the case are local activists in Ecuador who have opposed the mine, on the grounds that it will create major deforestation and desertification in the area and threaten more than a dozen animals with extinction. They allege that Copper Mesa through its agents used armed assaults and death threats to intimidate the local activists. Due to a perceived inability to hold Copper Mesa accountable in their country, the Plaintiffs brought a suit in Ontario against Copper Mesa, its directors, and the TSX.
The most novel aspect of the suit is the claim against the TSX for approving and listing Copper Mesa on the exchange, resulting in an influx of capital that would allegedly be used for further intimidation and violence against opponents. Local politicians in Ecuador and environmental supporters in Canada had brought the human rights allegations to the attention of the TSX before its listing. Further, the final prospectus filed by Copper Mesa’s subsidiary to the TSX acknowledge the existence of the conflict,
“[t]ensions surrounding potential exploration and mining work on the Junin property have risen, creating the potential of further escalating violence unless steps are taken to diffuse the situation,” and goes on to report a specific incident in which members of an “anti-mining group” felt “threatened”;
The liability, according to the Plaintiffs, flows from the failure to take any steps to avoid the violence, and that the Defendants knew or ought to have known that violence would ensue if the Copper Mesa subsidiary was financed through the TSX, and should have taken measures to ensure funds raised were not used for improper purposes. The project was highly dependent on funding from the TSX, with over 80% of the US$26.7 million raised by the Copper Mesa subsidiary raised on the TSX alone. According to the Plaintiffs, it was a brokered private placement of shares approved by the TSX that raised US$4.5 million that allowed Copper Mesa to hire the private security forces allegedly responsible for the armed assaults that form the basis of the claim.
The TSX is considered a specialized exchange for mining, and over 60% of the world’s mining companies are listed on the TSX and related exchanges.

Ecuadorians Lose Appeal in Lawsuit Against Canadian Mining Company and TSX
Canadian law continues to fail communities harmed by Canadian mining overseas
On March 11, 2011, the Court of Appeal for Ontario dismissed an appeal by Ecuadorian campesinos who say they were assaulted by security forces hired on behalf of a Canadian mining company in their native Ecuador (see video of one of the assaults at right).

Marcia Ramírez, Polivio Peréz and Israel Peréz had sued Canadian mining company Copper Mesa Mining Corporation and two of its directors as well as the Toronto Stock Exchange, which the Ecuadorians say listed the mining company on its stock exchange after having been warned that money from the listing would lead to violence. The Plaintiffs had appealed an earlier decision that dismissed their lawsuit.

In the ruling, the Court recognized that “[t]he threats and assaults alleged by the plaintiffs are serious wrongs. Nothing in these reasons should be taken as undermining the plaintiffs’ rights to seek appropriate redress for those wrongs”, but nonetheless ruled against the Ecuadorians.

COPPER MESA DELISTED FROM THE TORONTO STOCK EXCHANGE!!

Last Friday (Feb. 19) was the last trading day for Copper Mesa on the Toronto Stock Exchange!!!

As most of you know, on January 19 of this year, the Toronto Stock Exchange took the decision of delisting Copper Mesa Mining Corporation from the exchange.

Interestingly, the company did not appeal the TSX’s decision, and is now trading on what is known as the Pink Sheets (Over the Counter Bulletin Board). This is the least prestigious place for companies to trade their shares, since it is a completely unregulated marketplace (much, much less so than even the barely regulated TSX). Most companies here either are pirate companies, or are very close to bankruptcy (and/or were unable to comply with regulations in other stock exchanges). In other words, unsavory, high-risk enterprises.

In real terms, what this means that it’s all over for Copper Mesa. They will not be able to raise capital, and will likely soon file for bankruptcy. For us it means they will not be able to keep funding the social havoc in our communities, nor violate our rights anymore. On a more general note, it sends a powerful message to other communities fighting mining projects that a delisting like this is indeed possible.

In spite of such fantastic outcome, we are concerned by the presence of a pseudo agricultural company using a couple of the company’s properties within the mining concession. The company, Schwarz and Drouet, offers services to the oil industry, and has hired a few of Copper Mesa’s old employees, plus has been given away some small gifts to the locals. Their presence is probably meant to keep a low-profile presence in case the mining project is reactivated. In such scenario, they’ll be able to sell their land to the new company. The use of the land by this company also makes it harder for the communities to invade it, or the local government expropriate it.
