Company Overview

Nexicon’s history stretches back to 2003 when Nexicon founder and CTO Tommy Stiansen designed and developed a telephone billing system, named ‘Charon’ that would be purchased and implemented by several Norwegian phone companies serving over 1,000,000 subscribers. When Stiansen sold Charon in 2005, he began re-engineering the software to monitor Internet traffic instead of phone traffic for billing purposes. Stiansen’s background as a prolific and accomplished computer hacker in the late ‘90s assisted his development of this new solution. In the tight-knit anonymous community of hackers, Stiansen was able to penetrate the most secure of networks. In 2005, Stiansen was hired by a U.S. company to provide network security assessments for the U.S. government and several Fortune 500 companies.

While developing the new solution, Stiansen was introduced to Nexicon CEO Richard Urrea, an entrepreneur who had substantial experience in start-up companies. Within six months Nexicon Inc. was born. Stiansen spent two years building and enhancing what would become known as the MARC Anti-Piracy Platform, and by early 2007, the company welcomed four motion picture studios as clients. Nexicon’s flagship product, GetAmnesty, is used by copyright holders as the conduit through which they can collect revenues lost to online piracy. Upon its launch, the program collected settlement fees within in 11 minutes of sending the first infringement notice. By leveraging expansive, anonymous networks to track users, the MARC Anti-Piracy Platform is changing the game for copyright holders worldwide.

MARC helps copyright holders end piracy by identifying both the pirates who are illegally “seeding” the copyrighted material as well as the “fans” of the copyrighted material who are illegally downloading the files. Nexicon’s collection products (GetAmnesty and DigitalRanger) leverage the MARC platform to collect settlement fees from the downloaders, and help investigate and enforce copyright laws that support content owners.

MONITOR


MARC monitors every conversation on the Internet Relay Chat (IRC) system, simultaneously tracking more than 80,000 files at one time. In a single day, MARC inspects 19.6 billion file transmissions using three agent servers -- and since the platform is easily scalable, the number of files to be scanned can be easily increased by adding servers. The platform monitors potential infringement data through a global network of data mining agents that scan Internet protocols such as BitTorrent, Ares, auctions, Gnutella, and newsgroups. As pirates leverage new distribution methods, Nexicon engineers can quickly adapt the platform to monitor any new protocol. Nexicon knows of no other technology that monitors Internet file transfer activity on a scale close to the MARC Anti-Piracy Platform .

ANALYZE

After MARC collects the potential infringement data, the Analyze process filters the data through a proprietary “rating engine” to find known infringers. The rating engine, also called a “threat matrix,” is comprised of artificial intelligence made possible through third-party data of known infringers’ IP addresses as well as Nexicon’s own piracy data collected since 2000. Evolved from sophisticated telephony billing software, the rating engine is the backbone of MARC – it does the heavy lifting to find infringers. In competitive anti-piracy systems, false-positive instances of piracy are common. Nexicon’s artificial intelligence matches a downloaded file to a known copyrighted version of the title, reducing false positives. When a Nexicon client requires an absolute guarantee as to a pirated title’s legitimacy (e.g. to support litigation or for theatrical release planning), the Automated Human Visual Verification™ (AHVV) feature is leveraged. Titles are verified at a rate 50X faster than competing methods, translating into reduced costs and improved efficiency for clients.

REPORT

After performing the necessary tasks to analyze and validate the collected data, MARC begins generating the products used by Nexicon customers. The reporting products – Business Intelligence and DataView – produce the most relevant, accurate and actionable intelligence available today to copyright holders. MARC’s reporting options range from the simple DataView, where a text file is transmitted via secure FTP to a customer for analysis by its own analytic reporting software, to the advanced, user-friendly Business Intelligence reports designed for executive-level readers. With these reports, aggregated piracy data provides business users trend information on who is downloading what files, and where and when it happens. The Business Intelligence reports are the first step toward educating copyright holders about the scope of their piracy problems.

COLLECT

The final component of the MARC Anti-Piracy Platform is comprised of Nexicon’s collection products: GetAmnesty and DigitalRanger. With these products, copyright holders literally turn piracy into profits. With GetAmnesty, individuals who have violated copyright laws by downloading protected content, identified during the Monitor process and verified during the Analyze process, are offered an option to settle with the copyright holder and avoid any legal action. It begins with Nexicon sending the downloader’s ISP a DMCA notice which is auto-generated by MARC. The ISP is then legally obligated to forward this notice to the infringer. The user clicks a link within the email taking them to the GetAmnesty website, and in less than three clicks, the user can settle with the copyright holder for a nominal fee. While GetAmnesty targets the fans of copyrighted material, DigitalRanger targets the more malicious side of piracy – the seeders of the illegally shared files. DigitalRanger investigates and targets high-volume pirates who distribute large volumes of protected material, and enforces copyright laws. The program includes the ability to automatically collect evidence and store in its DigitalRanger tool, for use in litigation. DigitalRanger is an easy-to-use web-based software application most commonly used by the legal departments of Nexicon’s clients. If prosecution is warranted against pirates, DigitalRanger ensures that the copyright holder has implausible data in court.


Comprised of piracy reports tailored to “C-level” executives and anti-piracy business managers at copyright organizations, these reports provide easily understandable yet critical information, answers, and analysis about pirated digital media.

As they are focused toward business users, the Business Intelligence reports are easy-to-read and understand, and do not require any 3rd party analytical software for viewing.

HOW IT WORKS

After monitoring and analyzing online piracy traffic from all major Internet protocols each day, Nexicon’s robust MARC Anti-Piracy Platform stores the data in a warehouse database. The warehouse then aggregates the collected infringement information and generates reports in an easy-to-read .xls or .pdf format. The reports provide historical and trend analysis, and typically include an aggregated profile based on a certain title or a portfolio of titles. Data is presented geographically and with other multi-dimensional attributes to provide the user with the necessary information to make an informed decision. Third party databases (Nielsen, etc.) are incorporated to present a complete perspective for the user.

THE VALUE

Properly timing the release of blockbuster movie can be a “make or break” scenario for motion picture studios. Business Intelligence reports help movie producers determine the correct time and/or location to release a film. Understanding which markets are downloading and viewing pirated versions of the motion picture can affect future releases and also be used to target the “seeder” of the original pirated copy. Through Business Intelligence reports, copyright owners can obtain aggregated infringement data on a per-title basis, thus viewing any trends associated with infringements for the specific title such as a song or motion picture. To stop the piracy, copyright holders can then use another Nexicon product, DigitalRanger, to track the originally leaked source of the copyrighted material and provide its legal team indisputable identity data to litigate against the pirate.

THE TECHNOLOGY

The “Monitor” portion of the MARC Anti-Piracy Platform collects billions of illegal and legal copyright downloads around the clock. MARC’s rating engine then sifts through this data to validate which of the downloads are indeed infringements. MARC’s data warehouse aggregates the infringement data into a readable format for business executives. Behind all of this stands Nexicon’s artificial intelligence and extensive profiling algorithms which analyze every aspect of the collected data and compares to historical events and third party databases.

HOW IT WORKS

Nexicon monitors a variety of Internet protocols such as Ares, Limewire, Kazaa, BitTorrent, auctions and newsgroups, and tracks the identity of the computer that is illegally downloading different copyrighted files. Nexicon confirms that the files downloaded violate a copyright through its technology platforms’ artificial intelligence and Automated Human Visual Verification (AHVV) technology. Once the file is confirmed to be an illegally downloaded file, Nexicon sends a DMCA notice via email to the infringer’s ISP, who is legally required to forward the email to the infringer. After opening the email, the infringer clicks a link to visit GetAmnesty.com, where they can settle their infringement to avoid legal action and receive a legal release from the copyright owner.

THE VALUE

GetAmnesty provides content owners with a new revenue stream by collecting settlement fees on their behalf from those who illegally download their copyrighted content. Further, violators are tagged with a complete history of their downloading activities, which is easily translated to create customer profiles for online marketing purposes.

HOW IT WORKS

DigitalRanger is a web-based application, hosted by Nexicon, and accessed by clients through a secure internet connection. Nexicon’s MARC platform monitors and analyzes pirate activity, and then feeds the results of pirates to DigitalRanger. The user logs in to an intuitive dashboard, where only the critical, actionable data is presented: a pirate’s city/state/country, the client’s media being pirated, and an IP address and related identifying information. DigitalRanger uses artificial intelligence to automatically assign a ‘threat rating’ for each pirate, helping the user to efficiently evaluate upon which pirates to take action.

DigitalRanger provides indisputable evidence to support copyright holders’ litigation efforts against digital media pirates. Customers can then pursue larger monetary settlements from the pirates, directly turning piracy into profits. Additionally, DigitalRanger can provide information to facilitate ISP’s turning off a pirate’s Internet connection, thus preventing further piracy efforts.

HOW IT WORKS

In today’s world, ISPs are inundated each day with electronic DMCA notices in the form of emails from copyright holders and their agents, demanding that subscribers “cease and desist” from activity which constitute one or many copyright infringements. Nexicon’s Envoy system dramatically improves this process, by allowing the ISP to tightly control and manage the task of notifying customers about infringements. With Envoy in place, an ISP’s abuse department will see the specific infringements that occurred over their infrastructure and automatically notify their customer via email with the DMCA notice provided Nexicon. All of this is made possible by integrating Envoy with Nexicon’s MARC platform, where billions of file transmissions are analyzed each day and verified infringements stored on behalf of our clients.

THE VALUE

Significant hard-dollar savings can be realized by Envoy-enabled ISPs by reducing staffing levels charged with processing DMCA notices. Further automation is possible by seamlessly integrating Envoy to an ISP’s CRM or service management system. ISPs will take great comfort in knowing that infringements provided by Nexicon contain more evidence that any other DMCA agent on the market today and that infringements are validated by Nexicon’s Automated Human Visual Verification (AHVV™) system.

THE TECHNOLOGY


Envoy is a web-based, streamlined graphical user interface into Nexicon’s MARC databases. The user is presented in real-time (after verification by AHVV) a complete inventory of infringements processed by Nexicon on behalf of its copyright owner clients. Only infringements related to the ISP for which the IP address is subscribed are shown to the user. With a simple click, the user can process the notices and transmit to their subscriber, through email or any other third-party software product which might present a real-time notification to a subscriber. The system is elegantly simple and implementation can be performed in a matter of days.

In today’s Web 2.0 environment, artists and content owners are keenly aware of the value that User Generated Content (UGC’s) services such as YouTube™ can provide to increase exposure for their work. Less clear for rights holders is how their digital media should be managed, delivered to UGC’s, and monetized. Nexicon’s YouScout solves this problem by helping content owners store, distribute and manage their content on the most popular community-driven sites on the Internet.

HOW IT WORKS

Nexicon has entered into a partnership with YouTube to use the company’s proprietary Content Management System (CMS) on behalf of content holders. The CMS tool automatically scans user-uploaded content to YouTube, and through its fingerprinting capability, scans for matches to original files provided by the content owner. The content owner is able to either 1) remove the content, 2) keep the media to gain valuable reporting, 3) keep the media and add online ads, of which revenue is shared between the owner, YouTube and Nexicon.

The content owner provides Nexicon their digital assets (i.e. live concerts, songs, movies, television shows, etc.) and business rules pertaining to how content needs to be managed, and Nexicon handles the rest. All content is inventoried, organized and stored in YouScout through Nexicon’s secure database servers. YouScout handles all of tasks related to the uploading, distribution and management of the client’s digital media on YouTube.
